Subscriptions & Billing

• Pro: $24/year, auto-renews until canceled. The renewal price/frequency is shown at checkout.
• Free features do not require an account. Pro features require an active subscription.
• Payments are processed by our provider (e.g., Stripe). We do not store full card details on our servers.

Auto-renewal disclosures: By subscribing, you authorize recurring charges at the stated interval until you cancel. We send an email acknowledgment with renewal terms and cancellation instructions. For annual plans, where required by law, we send a renewal reminder 15–45 days before renewal. You can cancel online at any time as described below.

Cancellations & Refunds

• Click-to-quit: cancel from your account’s Billing Portal → Cancel subscription (online), or email support@seabird.biz using your receipt email.
• Cancel any time before renewal to stop future charges; access remains active through the end of the paid term.
• Unless required by law, fees are non-refundable and there are no prorated refunds for partial periods.

Effect of cancellation: we may immediately downgrade Pro features at the end of the paid term; your account may remain for Free use.

License & Restrictions

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use SeaBird Concentration solely for lawful personal or organizational team-building purposes, in accordance with these Terms.

You must not (and must not permit anyone to):

• reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, underlying ideas, algorithms, or non-public APIs (except where permitted by law);
• bypass, interfere with, or disable any security, anti-cheat, rate-limit, paywall, or access-control features;
• access, search, or copy the Service or content using bots, scrapers, or similar tools (except standard web indexing for search engines);
• resell, sublicense, lease, or provide the Service to third parties as a service bureau;
• upload, post, or transmit any malware, automated gameplay/“botting,” artificial score inflation, or other activity intended to manipulate leaderboards or system metrics;
• remove, obscure, or alter any notices (including copyright or trademark notices).

We may monitor use to protect the Service and enforce these Terms.

Intellectual Property, Your Content & Feedback

Our IP. The Service (software, game mechanics, text, graphics, logos, audio, and other content) is owned by SeaBird or its licensors and protected by IP laws. Except for the license above, no rights are granted.

Your Content. If you upload words/images (e.g., for custom puzzles), you represent you have the necessary rights and grant SeaBird a worldwide, royalty-free license to host, reproduce, and display that content solely to operate and improve the Service. You retain ownership of your content.

Feedback. If you send feedback or suggestions, we may use them without restriction or obligation to you.

Game Integrity & Anti-Abuse

To maintain fair play, we may collect and analyze limited telemetry (e.g., session timing, event sequences, abnormal interaction rates) to detect fraud/abuse and automated gameplay. We may suspend, limit, reset scores, or terminate access for behavior that compromises Service integrity.

Copyright & DMCA Policy

We respect copyright. If you believe content on the Service infringes your rights, send a notice to our Designated Agent listed at /dmca including: (1) your signature; (2) identification of the work and the allegedly infringing material; (3) contact info; (4) your good-faith belief the use is unauthorized; and (5) a statement under penalty of perjury regarding accuracy and authority. We may remove or disable access to reported material and, where appropriate, terminate accounts of repeat infringers. Counter-notice procedures are provided at /dmca.

Security & Phishing

We’ll never ask for your password or full payment details by email or chat. Enter payment information only on our provider’s hosted checkout pages. Where used, forms display: “Protected by reCAPTCHA and the Google Privacy Policy and Terms apply.”

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEABIRD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEABIRD AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; THESE TERMS APPLY ONLY TO THE EXTENT PERMITTED.

Indemnity

You will defend and indemnify SeaBird against third-party claims arising from (a) your content; (b) your unlawful use of the Service; or (c) your breach of these Terms.

Export Controls & Sanctions

You represent that you are not located in, and will not use the Service in, any jurisdiction subject to U.S. embargo or in violation of U.S. export/sanctions laws, and you are not a prohibited end user under such laws.

Governing Law & Disputes

These Terms are governed by the laws of the State of Maryland, without regard to its conflicts of law rules. You and SeaBird consent to the exclusive jurisdiction and venue of the state and federal courts located in Baltimore, Maryland for all disputes arising out of or relating to the Service or these Terms.

Changes to the Service or Terms

We may update the service or these terms to improve functionality, address security, or comply with law. If a change is material, we’ll provide reasonable notice (e.g., email or in-app) where feasible. Continued use after an update means you accept the revised terms.

Miscellaneous

• Force Majeure: we are not responsible for delays or failures caused by events beyond our reasonable control.
• Assignment: you may not assign these Terms without our consent; we may assign to an affiliate or in connection with a merger, acquisition, or asset sale.
• Severability: if any provision is unenforceable, the remainder remains in effect.
• No Waiver: failure to enforce is not a waiver of rights.
• Entire Agreement: these Terms (and any policies referenced by link) are the entire agreement between you and SeaBird regarding the Service.
• Notices: we may send notices to the email on your account or by posting to the Service.
